These are Elanguest's terms and conditions. Please read them before booking a course.

All bookings are subjects to availability.
No booking has been accepted until Elanguest has issued an invoice to the student or agent.
Each member of a group, booked by a third party is bound by these conditions. The third party is responsible for informing the students about these terms and conditions.

Complaints

In case of a complaint or difficulty - it is essential that the student immediately makes his/her complaint or problem known to the Elanguest school office during their time spent in Malta. The office on the 1st floor will provide complaint forms as all complaints must be documented in writing. Students' complaints will be addressed by the relevant department head who will subsequently inform the student of the outcome of their enquiry. The student cannot claim for compensation after leaving Malta if he/she had not made the problem or complaint known and given the school the opportunity to offer a satisfactory solution. Elanguest must be advised of any health problems which may affect the student’s course attendance or accommodation, or the courses / accommodation of other students.

Payments

A non-refundable 20% deposit of the total amount must be paid immediately upon booking. A booking confirmation will only be sent when the deposit has been received. Elanguest is under no obligation to confirm registration until the school has received evidence of this payment.
A faxed or e-mailed copy of the bank transfer documents will be acceptable.
All bank transfer fees must be paid by the student.
Extra deposits for the booking of certain hotels may be required in high seasons.
The conditions which are stated in the hotel’s pricelist will apply.

Refunds and Cancellations

Should a refund be given for any reason after full payment has been received, Elanguest will charge an administration fee of €50.00 and deduct relevant bank charges from payment.
Elanguest accepts no obligation to return course or accommodation fees to no-shows or to any student who is unable to complete his/her course. For cancellation policies before or after arrival, see below.

HOTEL CANCELLATIONS: are subject to the cancellation fees which are stated in the hotels’ price- list. These fees should be carefully inspected before confirming your booking. In confirming your hotel booking, you are confirming acceptance of the hotel’s cancellation fees.

HOST FAMILY CANCELLATIONS: made more than 7 days prior to a student’s course or accommodation start date (whichever comes first), are subject to a charge of 20% of the total amount of the

accommodation fees for stays of 4 weeks or over and not less than one week’s accommodation fee for shorter stays. Cancellations made less than 7 days prior to a student’s course or accommodation start date (whichever comes first), or without due notice after the student’s arrival, are subject to a charge of 50% of the total amount of the accommodation fees for stays of 4 weeks or over. For stays of 3 to 4 weeks, not less than 2 weeks accommodation fees will be deducted. For stays of 1 or 2 weeks, the total amount will be charged as a cancellation fee.

ELANGUEST SELF-CATERING APARTMENTS: are covered by the same cancellation terms as the Host Family accommodation stated above.

COURSE CANCELLATIONS
When a course cancellation is made more than 14 days prior to a student’s course or accommodation start date (whichever comes first), the cancellation fee of 20% of the total amount will apply. When a course cancellation is made 8-14 days prior to a student’s course or accommodation start date (whichever comes first), a cancellation fee of 30% of the total amount will apply. When a course cancellation is made 1-7 days prior to a student’s course or accommodation start date (whichever comes first), a cancellation fee of 50% of the total amount will apply.

COURSE CHANGES AFTER ARRIVAL
If a student decides to change his/her course after arrival, it is only possible if they are going to upgrade their course and settle the difference in fees. In certain cases, for instance changing to Private Lessons,
an administration charge of €50 may be applied. Changing from a more expensive course to a less expensive course will not result in a refund of the difference in price.

Transfers

Students who are booked into one of Elanguest’s self-catering apartments must use the school’s transport for collection at the airport. Elanguest’s driver will then be able to hand over the apartment keys and make sure that they arrive safely to the apartment.

Full flight details must be received by the school no later than 7 days before the arrival date. If those details are not communicated before that deadline, Elanguest is in no way responsible for not organising any transfer or any key for the student's apartments and no refund for the taxi will be given.

New arrivals

On the first day of their course, new students should arrive at the school at 07:30 to take an assessment test. If any changes are made to this arrangement, the students will be notified in advance.

Punctuality

All students should note that they may be asked to wait for the following class session if they arrive 15 or more minutes late for the start of any lesson.

Accommodation

For apartments and families, Elanguest reserves the right to charge for extra, unused, days for mid-week arrivals and departures especially during the high season (29/06/2014 - 27/09/2014).
If any damage is incurred by the student to property of the school or belongings to third parties contracted by the school, the cost of these damages must be settled immediately and are payable to the school.
Elanguest expects all students to respect the right of fellow students to a safe and orderly environment within the school’s self-catering apartments and host families.
Students are responsible for the day to day cleaning of their apartments. Elanguest will prepare bedrooms for new arrivals, clean the common parts and change bed linen once per week. The changing of the bed linen and cleaning of the common parts may be on separate days.
Students must respect the Apartment Rules that are given to every student and displayed in all the school's apartments. Any transgression of these rules can be a reason for exclusion.

Check in time - 14:00 hrs
Check out time - 11:00 hrs

Students may remain in the apartment until their flight departure time but must have checked out of their room by 11:00 am.
Elanguest is not responsible for untidied rooms in case of early arrivals before 14:00 hours.
Elanguest does not provide towels in the apartments; it is the students' responsibility to provide their own towel.

Liability

It is the student’s responsibility to ensure that they obtain all documentation (passport, visa, etc.) required for entry into the country, and to make themselves aware of any legal requirement or restriction that would hinder or prevent them travelling.
Elanguest will not be held liable if a student is refused entry into any country for any reason.
The student is solely responsible for complying with formalities required by police, customs or health authorities at the point of departure or arrival, at a particular destination, or whilst in transit.
Should the school accept a student under the age of 18 years, a valid release form signed by their parents or legal guardians must be completed at the time of booking. Elanguest is not responsible for the supervision of these minors after lesson time. This supervision remains the responsibility of the parents or legal guardians.

Insurance Liabilities

The student is responsible for obtaining adequate travel insurance, including coverage for cancellations, health insurance, loss and theft of baggage, money and personal items, emergency evacuation, and for any other eventuality that may occur before, after or during the student's journey and for the duration of their stay. Elanguest shall in no way be deemed responsible for any costs incurred as a result of the student/client having no or insufficient insurance cover.
Elanguest is not to be held liable for loss, theft, damage or injury to persons or personal property.

Force Majeure

Elanguest shall not be liable for any failure of or delay in the performance of its services for any period that such failure or delay is due to causes beyond its reasonable control, including but not limited to acts of God, war, the threat of war, strikes or labour disputes, disease, embargoes, government orders or any other force majeure event.

Disruptive Exclusion

The school reserves the right to exclude a student from the school or accommodation if they are acting in a way which is detrimental to the school or other students. In such cases, the school is under no obligation to make any refund or cover any expense brought about by this action. Furthermore, the school will not be held responsible for repatriation expenses.

Courses & Essential levels

Course fees include tuition and course material used during the tuition period. This does not include extra reference books, workbooks or dictionaries which are available at the school for personal study. The following is a list of the pre-required levels of English for specific courses:
General English Courses – taught at all levels
Business English – taught at all levels
Medical English – pre-intermediate level required
ESP Courses - pre-intermediate level required
Students attending Cambridge exam courses will be asked to complete a written assignment at the time of booking for assessment purposes, and advised which course is most suitable for their level. The student will be re-assessed on their first day at the school, in order to re-check their chosen level's suitability across all skills. The final decision on level testing and course-allocation rests with the school.

With all courses, including requests for changes in level or class, Elanguest reserves the right to place a student into a class according to the results of an assessment test, which will be administered by the school at the start of their course.

Reduction of lessons

When only two students are present for General English the tuition time will be given as 2½ hours per day instead of 3 hours. If only 1 student is present it will be given as 2 hours private lessons per day.

When only one student is present for the following courses, private tuition will be given as follows:

General Intensive: 3 hours per day
Intensive Mini-Group: 3 hours per day
Business English: 2 hours per day
Intensive Business: 3½ hours per day
Cambridge ESOL and IELTS: 3 hours Cambridge focus private tuition per day
ESP courses including Medical English courses: 3 hours ESP per day

Survival English: 3 hours General English + 1½ hours private Survival English per day

Public Holidays 2014 (week days only)

Elanguest is not obliged to give lessons during Public Holidays. When there is a bank holiday in the week, the school will close on the bank holiday, and the lost hours will be partially made up over the remaining four days.

The school is closed during the following public holidays:

10th February, 19th March, 31st March, 18th April, 1st May, 15th August, 8th September, 8th December

Course Certificates
Elanguest reserves the right to refrain from giving a Course Certificate to any student who misses more than 20% of the course for no valid reason. The level on the certificate is decided by the school, not the students.
