Elanguest English Online Campus - Terms & Conditions
ii) Elanguest English Campus Online means the services, virtual classroom, E-books and whiteboard material given or created by Elanguest Ltd, Keating House, Ross Street, Malta
iii) Participant means ‘The user’.
iv) Macmillan Resources means the use of Macmillan Copyrighted material used by Elanguest English Campus Online. “Macmillan” means Macmillan Publishers Limited, whose registered office is at Brunel Road, Houndmills, Basingstoke, Hampshire RG21 6XS, England.
End User Agreement
These terms and conditions are for the use of the Elanguest English Online Campus and all course material, including the Macmillan Resources and whiteboard services offered through the Elanguest English Online Campus courses.
Please read these terms and conditions carefully. Your use of Elanguest English Online Campus will be subject to these terms and conditions. In becoming a member of the Elanguest English Online Campus you are accepting this agreement are stating that you are aware and agree to the following:
1. Courses
1.1 Courses offered on Elanguest English Online Campus are subject to availability and bookings must be confirmed by Elanguest.
1.2 Cancellations and Refunds: Elanguest does not give refunds for non use of the product for any reason or for termination of the course before its completion.
1.3 Certificate of course completion / attendance will only be given when the participant has attended at least 50% of the live sessions and completed at least 80% of the assigned coursework. Course Certificates will also require the participant to complete the final test assignment and be present during the final live testing session.
1.4 Elanguest reserves the right to reschedule live sessions when they are cancelled due to local power failures or serious situations which are not under our control.
1.5 Elanguest is not obliged to reschedule live sessions to suit the participant’s personal timetable or when the participant has technical problems which prevent them from taking part.
2. What you are allowed to do in the Virtual Classroom and on the Macmillan Resource Site
2.1 Provided that Elanguest school has issued you with a password to allow you to access the Macmillan English Campus, you may use the Macmillan English Campus for personal use (or, if you are a teacher, for teaching use) and in accordance with these terms.
2.2 You may:
(a) browse the Macmillan English Campus using a compatible web browser. Permission to browse the Macmillan English Campus includes permission to make transient or cached copies of parts of the Macmillan English Campus to the extent that this occurs in the normal course of using your browser and that these copies are used only to facilitate current or subsequent access to the Macmillan English Campus by you:
(b) print a copy of any page of the Macmillan English Campus:
(c) select one of the four pre-determined options in the "Personalization" feature of the Macmillan English Campus to personalise the look and feel of the Macmillan English Campus as it appears through your web browser:
(d) use the Study Area or Work Area features of the Macmillan English Campus to set up and use:
(i) Web Links to allow you to link direct from your personal Study Area or Work Area on the Macmillan English Campus to other useful web sites:
(ii) Wordlists to allow you to keep lists of useful vocabulary:
(iii) Bookmarks to allow you to link direct from your personal Study Area or Work Area on the Macmillan English Campus to other useful resources within the Macmillan English Campus:
for your own personal purposes, provided you do not do any of the things set out under “What you are not allowed to do”.
2.3 If you are a teacher who has been issued with user details to allow you to access the Macmillan English Campus for teaching purposes, you may also print off one copy of any page of the Macmillan English Campus for each of your students for their own personal use, provided you do not do any of the things set out under "What you are not allowed to do".
2.4 You may access the virtual classroom at any time and talk and meet other students there. The classroom is reserved for the use of course members to download and listen to recorded sessions, discuss the material with other class members, use the whiteboard and audio visual tools when rights have previously been assigned by the moderator / teacher during live sessions.
2.5 Users are obliged to download the Java tools provided and to enter the room well before the lesson time to use the audio setup tools.
2.6 Users are responsible for their own internet access and technical readiness for the course.
2.7 Users must download and install the following: latest versions of a suitable pdf reader, flash reader, and be able to download and install the java file on the computer used to access the Virtual Classroom. This is an automatic download which is activated when you enter the classroom and will be required at every session.
3. What you are not allowed to do
3.1 Except to the extent expressly set out in these terms, you are not allowed to make any copies of any part of the Macmillan English Campus or any of the e-books that are downloaded.
3.2 Except to the extent expressly set out in these terms, you may not remove or change anything on the Macmillan English Campus or Elanguest e-books
3.3 Except to the extent expressly set out in these terms, you may not include or create links to or from the Macmillan English Campus.
3.4 You are not allowed to copy or use any material from the Macmillan English Campus or Elanguest e-books for any commercial purpose.
3.5 You are not allowed to remove or change any copyright, trade mark or other intellectual property right notices contained in the original material or from any material copied or printed off from the Macmillan English Campus or Elanguest material.
3.6 You must only use the Elanguest virtual classrooms and Macmillan English Campus which includes anything available from the Macmillan English Campus for lawful purposes and you must comply with all applicable laws, statutes and regulations. You must not use the Elanguest virtual classrooms or Macmillan English Campus to:
(a) post, upload or otherwise access or transmit information or pictures that are obscene or pornographic, threatening, menacing, racist, offensive, defamatory or otherwise unlawful:
(b) upload files that contain software or other materials or otherwise post material or information in breach of any intellectual property rights or in breach of confidence:
(c) download any file or materials that you know, or reasonably should know cannot be copied or otherwise used:
(d) harass, stalk, threaten or otherwise violate the rights of others:
(e) harm or threaten to cause harm to minors:
(f) impersonate anyone else or otherwise misrepresent your identity or status:
(g) hack into the Macmillan English Campus or any other related computer system, make excessive traffic demands, deliver viruses or forward chain letters, surveys, contests, pyramid schemes or otherwise engage in any other behaviour that may reasonably be expected to inhibit other users from using and enjoying the Virtual Classrooms or Macmillan English Campus or any other website or damage or destroy the reputation of Elanguest or Macmillan or any third party:
(h) collect and process others’ personal data:
(i) post any information or material which is inaccurate, unfair or misleading:
(j) access the Virtual Classroom or the Macmillan English Campus using any other means than with the personal access details provided to you by Elanguest school.
3.7 Elanguest reserves the right to block your access and to take such other action as may be reasonably necessary to prevent any breach of these terms and conditions or any breach of applicable law or regulation. Elanguest will also in its absolute discretion fully co-operate with law enforcement and other relevant authorities with respect to any investigation of suspected unlawful activity or violation of network security.
4. Passwords and Classroom URL’s
4.1 You must keep the password which allows you to access the Macmillan English Campus confidential at all times, and must not disclose it or permit anyone else to use it. Any breach of any of these terms by anyone to whom you disclose your user details will be treated as if the breach had been committed by you, and will not relieve you of your obligations under these terms and conditions.
4.2 You must not share or encourage the unauthorized use of the Virtual Classroom URL.
4.3 Elanguest reserves the right to change your user details at any time in its sole discretion.
5. Rights
All intellectual property rights in any material (including text, photographs and other images and sound, trade marks and logos) contained in the Macmillan English Campus is owned by Macmillan. All intellectual property rights in any material (including text, photographs and other images and sound, trade marks and logos) contained the Elanguest E-books or other material created by Elanguest is owned by Elanguest. You are only allowed to use the Macmillan English Campus and Elanguest Virtual Classroom and the material contained in the Macmillan English Campus and downloaded in the classroom as set out in these terms.
6. Data Protection
6.1 In accordance with European law relating to data protection, all personal information provided by you will be used exclusively in relation to the use of and access to Elanguest Virtual Classroom and Elanguest/Macmillan English Campus. Your personal data will be treated in accordance with the laws regarding the protection of personal data and will be protected in such a way as to ensure its security (in particular with regard to unauthorised access and accidental loss) and confidentiality.
6.2 Your personal data will be made available only to:
6.2.1 teachers and administrators authorised by member schools of Elanguest Ltd.
6.2.2 Elanguest Director of Studies in his/her capacity as senior administrator of Elanguest/Macmillan English Campus and Elanguest Virtual Classrooms.
6.3 Your personal data will only be used in direct connection with the administration of Elanguest Macmillan English Campus, and the teaching of your English courses using Elanguest Macmillan English Campus and Elanguest Virtual Classrooms.
6.4 Under the laws relating to personal data protection, you have the right to access all such personal data, and to request the modification, updating or deletion of any personal records if these are incomplete, erroneous or have been created in violation of the law currently in force, by applying to the senior Elanguest administrator at Elanguest Ltd, Keating House, Ross Street, St Julians, STJ3243, Malta.
6.5 By accepting this present End User Agreement, you agree to your personal data being made available to the personnel defined in clause 6.2 above, and used in accordance with clause 6.3 above
7. Disclaimer and limitation of liability
7.1 Elanguest does not accept any liability for any error or omission in any information contained on the Macmillan English Campus or for any error or omission in any information used during live class sessions. Elanguest does not accept any liability for statements used by third parties using the learning platform but will be vigilant in barring those persons / users who disrupt the peaceful use of this platform by other users.
8. Suspension and termination of the Macmillan English Campus
8.1 The operation of the Macmillan English Campus may be suspended from time to time for repair or maintenance work or in order to update or upgrade the contents or functionality of the Macmillan English Campus. Access to or use of the Macmillan English Campus will be not necessarily be uninterrupted or error free.
8.2 The operation of the Live Virtual Classroom may be suspended from time to time to install updates and to repair the system or carry out maintenance work. Advance notice will be forwarded to the participants and re-scheduled sessions will be available. Should one or more of the participants be unable to attend these re-scheduled live events, they will be required to download and view the event as a recorded session.
8.3 No individual sessions will be created for participants who are unable to attend live sessions.
8.4 Elanguest may terminate your access to the Virtual Classrooms and the Macmillan English Campus immediately in the event you breach any of these terms and conditions.
